Agreement to Terms

By accessing or using Mizaan (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. Mizaan is operated from Edmonton, Alberta, Canada.

Service Description

Mizaan provides:

Zakat Calculation: Tools to calculate Zakat obligations based on user-provided asset information and selected Islamic school of jurisprudence (madhab)
Calculation History: Storage and retrieval of past calculations for registered users
AI Explanations: AI-powered explanations of calculation methodology and fiqh (Islamic jurisprudence) concepts
Shariah Screening: Stock and investment screening for Shariah compliance (free for all users)
Purification Tracking: Tools to track and calculate dividend purification amounts
Reminders: Optional email notifications for Hawl (anniversary) dates and Nisab threshold changes

Account Responsibilities

When you create an account, you agree to:

Provide accurate and complete registration information
Keep your login credentials secure and confidential
Notify us immediately of any unauthorized access to your account
Be responsible for all activity that occurs under your account
Not share your account with others or allow others to access your account
Be at least 18 years of age

You are responsible for ensuring the accuracy of the financial information you input. Mizaan calculates based on the data you provide and cannot verify the accuracy of your inputs.

Calculation Accuracy

While we strive for accuracy in our calculations:

Calculations are based on the asset values and information you provide. Incorrect inputs will result in incorrect calculations.
Nisab thresholds are based on real-time gold and silver prices from third-party sources, which may occasionally be delayed or inaccurate.
Fiqh rules are implemented based on scholarly consensus and documented sources, but interpretations may vary among scholars.
Shariah compliance screening is based on publicly available financial data and established screening criteria, but should not be considered a guarantee of compliance.

You should always verify important calculations and consult with qualified scholars for significant financial decisions.

Payment Terms

Free Tier

Basic Zakat calculations are available free of charge. Free tier users have limited AI explanation usage and cannot save calculations permanently.

Paid Subscriptions

Paid subscriptions provide additional features including:

Permanent calculation storage (The Vault)
Unlimited AI explanations
Portfolio tracking, brokerage linking, and purification tools
Email alerts and reminders

Billing

Payments are processed securely through Stripe
Subscriptions automatically renew unless cancelled before the renewal date
Prices are in USD and may be subject to applicable taxes
We may change subscription prices with 30 days notice
One-time purchases (Vault Pass) provide permanent access to purchased features

Refunds

If you are unsatisfied with a paid subscription, contact us within 14 days of purchase for a full refund. Refunds for periods beyond 14 days are at our discretion. One-time purchases are non-refundable after 14 days.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, you will retain access until the end of your current billing period.

Intellectual Property

The Mizaan name, logo, website design, software, and content are owned by Mizaan and protected by copyright and intellectual property laws. You may not:

Copy, modify, or distribute our software or content without permission
Use our trademarks without written authorization
Reverse engineer or attempt to extract our source code
Use automated tools to scrape or collect data from our service

You retain ownership of the data you input into Mizaan. By using our service, you grant us a license to process your data as necessary to provide the service.

Prohibited Uses

You agree not to:

Use the service for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the service or servers
Upload malicious code or content
Impersonate others or provide false information
Use the service to send spam or unsolicited communications
Resell or commercially exploit the service without authorization

Limitation of Liability

To the maximum extent permitted by law:

Mizaan is provided "as is" without warranties of any kind, express or implied
We do not guarantee that the service will be uninterrupted, error-free, or completely secure
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim
We are not liable for any religious, spiritual, or financial consequences arising from reliance on our calculations or AI explanations
We are not responsible for third-party services, including payment processors, data providers, or AI services

Indemnification

You agree to indemnify and hold harmless Mizaan and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, violation of these terms, or infringement of any third-party rights.

Termination

We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. Reasons for termination may include:

Violation of these Terms of Service
Fraudulent or illegal activity
Non-payment for paid services
Extended inactivity
Request by law enforcement or government agency

You may terminate your account at any time by deleting it through your account settings. Upon termination, your right to use the service ceases immediately.

Modifications to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by email or through a notice on the service. Your continued use of Mizaan after changes take effect constitutes acceptance of the modified terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these terms or your use of the service shall be resolved in the courts of Alberta, Canada, and you consent to the exclusive jurisdiction of those courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
