1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Mizaan Financial Technologies Inc., operating as Mizaan ("we," "us," or "our"), based in Edmonton, Alberta, Canada, for your use of the Mizaan mobile application ("App") available on the Apple App Store.

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree to these terms, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, strictly in accordance with this EULA and Apple's Usage Rules set forth in the App Store Terms of Service.

3. Description of Service

Mizaan is an Islamic finance application that provides:

Zakat and Khums calculation tools supporting multiple schools of Islamic jurisprudence
Shariah compliance screening for stocks and cryptocurrencies
Portfolio tracking and management
Dividend purification tracking
AI-powered explanations of Islamic finance concepts
Secure storage of calculation history

4. Important Disclaimers

4.1 Not Religious Advice

The App does not provide religious rulings (fatwas). All calculations and information are provided for educational and informational purposes only. The App presents calculations based on documented scholarly methodologies, but users should consult with qualified Islamic scholars for personal religious guidance.

4.2 Not Financial Advice

The App does not provide financial, investment, tax, or legal advice. Stock screening results and portfolio analysis are based on publicly available financial data and established screening methodologies (AAOIFI, DJIM), but should not be the sole basis for investment decisions.

4.3 Accuracy of Calculations

While we strive for accuracy, calculations depend on user-provided inputs and real-time market data from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of any calculations or data.

5. Subscriptions and In-App Purchases

5.1 Free Features

Basic Zakat and Khums calculations are available free of charge with no account required.

5.2 Paid Subscriptions

Premium features are available through in-app subscriptions:

Vault Pass: Save unlimited calculations, export PDFs, access calculation history
Concierge: All Vault features plus unlimited AI advisor, advanced portfolio screening, priority support

5.3 Billing

Subscriptions are billed through your Apple ID account. Payment will be charged upon confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID Account Settings.

5.4 Refunds

Refunds are handled by Apple in accordance with their App Store policies. To request a refund, visit Apple's Report a Problem page or contact Apple Support.

6. User Accounts

Some features require creating an account using email or Google Sign-In. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and current information
Notifying us immediately of any unauthorized access

7. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App
Remove or alter any proprietary notices or labels
Use the App to transmit harmful code or interfere with its operation
Use automated systems to access the App without permission
Resell, sublicense, or commercially exploit the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by Mizaan and are protected by international copyright, trademark, and other intellectual property laws. The calculation methodologies are based on documented Islamic jurisprudence sources which are cited within the App.

9. Third-Party Services

The App integrates with third-party services including:

Supabase: Authentication and data storage
Anthropic Claude: AI-powered explanations (Zakat, advisor chat)
Google Gemini: AI-powered explanations (Khums, screening)
Financial Modeling Prep: Stock financial data
MetalpriceAPI: Gold and silver prices
CoinGecko: Cryptocurrency data
RevenueCat: iOS subscription management
Firebase Cloud Messaging: Push notifications
SnapTrade: Brokerage account integration

Your use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIZAAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any errors or omissions in calculations or data
Unauthorized access to your data
Statements or conduct of any third party
Any other matter relating to the App

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of this EULA. Upon termination, your right to use the App will cease immediately. You may terminate this agreement by deleting the App from your devices.

13. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified EULA.

14. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15. Apple-Specific Terms

The following terms apply when you access or use the App through the Apple App Store:

15.1 Acknowledgement

You acknowledge that this EULA is concluded between you and Mizaan only, and not with Apple Inc. ("Apple"). Mizaan, not Apple, is solely responsible for the App and its content. This EULA may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

15.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

15.3 Maintenance and Support

Mizaan is solely responsible for providing maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

15.4 Warranty

Mizaan is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Mizaan's sole responsibility.

15.5 Product Claims

You acknowledge that Mizaan, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

15.6 Intellectual Property

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Mizaan, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

15.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.8 Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App, including your wireless data service agreement and any other relevant service agreements.

15.9 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
